1. Quotes and agreement
These terms apply to electrical, solar, battery and related services supplied by Orbit Electrical & Energy Pty Ltd (“Orbit”, “we” or “us”).
They form part of your agreement where supplied or linked before you accept our quote or authorise work. Any specific conditions agreed in writing in your quote take priority over these general terms, subject to applicable law. Later website updates do not change an existing agreement without your agreement.
Quotes cover the stated scope and remain valid for the period shown. Prices are in Australian dollars, with GST and the total payable identified on your quote.
2. Payment, deposits and progress payments
Payment is due by the date or milestone specified in your accepted quote or agreed payment schedule. Invoices will reflect those arrangements. Where no payment timeframe has been agreed, payment is due within seven days of the invoice date.
Larger jobs, staged installations and special-order equipment may require a deposit or progress payments. The amounts and payment stages will be disclosed before acceptance and must comply with any applicable legal requirements. Deposits and progress payments are credited towards the total price.
Please contact us promptly about any disputed amount. For overdue, undisputed payments, we may suspend further work after written notice and a reasonable opportunity to pay, subject to applicable law and making the site safe.
3. Changes and additional work
Your quote is based on the agreed scope and information reasonably available when it is prepared.
Changes you request, concealed faults, unsuitable existing wiring or unforeseen installation requirements may require a variation. We will explain the additional work, price and any timing changes and obtain your written approval before proceeding.
If an immediate safety risk is identified, we may stop work or isolate affected equipment as required. This does not authorise unrelated additional work or unrestricted charges.
4. Energex and other third-party charges
Unless expressly included in your quote, applicable Energex, electricity retailer and metering-provider charges are payable by you. These may include application, assessment, connection, disconnection, reconnection, meter alteration or network upgrade charges.
Orbit will endeavour to identify likely charges when quoting and notify you promptly when further charges become known. Before committing you to additional chargeable services on your behalf, we will obtain your approval. Third-party providers may invoice you directly.
5. Access and existing installations
You must have authority to approve the work and arrange any necessary owner or body corporate consent. Please provide safe access and tell us about known hazards, property defects or access restrictions.
Repairs to existing faults, asbestos removal, structural work, painting and plastering are excluded unless listed in your quote. Necessary additional work will be discussed under the variation process.
We will take reasonable care of your property. These exclusions do not remove our responsibility for damage caused by our work or failure to exercise due care and skill.
6. Scheduling and approvals
We will make reasonable efforts to meet agreed installation dates and notify you of delays. Weather, equipment availability, unsafe conditions and network or metering arrangements may affect scheduling.
We will discuss revised arrangements with you. Nothing in this clause removes your rights where work is not supplied within an agreed or reasonable time.
Solar and battery installations are subject to applicable network approvals and connection conditions. If approval is refused or requires a material change, we will discuss an alternative. You may decline that alternative and receive a refund for the unperformed installation, less only separately authorised application or assessment services already supplied where lawfully chargeable.
7. Solar and battery operation
Your quote will identify the equipment and any included backup capability. Battery installation does not automatically provide whole-home backup. Backup operation depends on the agreed design, connected loads, available charge and equipment limits.
Generation, savings and backup-duration estimates depend on the assumptions stated in your proposal, including usage, weather, shading, tariffs and network conditions. Estimates are not promises of a fixed outcome, but this does not limit our responsibility for accurate representations or a system suitable for its agreed purpose.
Where monitoring or network control requires an internet connection, we will explain the connection requirements.
8. Rebates and certificates
Any rebate or Small-scale Technology Certificate (STC) discount will be identified in your quote, together with relevant eligibility and assignment requirements.
You agree to provide accurate information and complete necessary documents. If eligibility, scheme rules or other assumptions change before installation, we will explain the effect and seek agreement before changing the price. No additional amount becomes payable simply through notice of a price change. If agreement cannot be reached, cancellation and refund rights will be assessed under these terms and applicable law.
9. Ownership of supplied goods
To the extent legally effective, goods and equipment supplied by Orbit remain the property of Orbit Electrical & Energy Pty Ltd until the final balance payable for those goods and their installation has been received in cleared funds.
This clause does not give Orbit an automatic right to enter your property, disconnect equipment or remove installed fixtures. Any recovery action must follow applicable law.
10. Cancellations
Please notify us as soon as possible if you need to cancel or reschedule.
For a change-of-mind cancellation outside any applicable cooling-off period, we may charge for authorised work already completed and reasonable, unavoidable costs directly incurred for your job, where permitted by law. We will account for supplier refunds, returned or reusable materials and costs saved, and provide an itemised explanation.
Any remaining deposit will be refunded. These charges do not apply where inconsistent with your statutory cancellation or refund rights. If Orbit cancels without customer breach, payments for goods or services not supplied will be refunded.
11. Consumer rights, warranties and concerns
Our goods and services are subject to Australian Consumer Law guarantees that cannot be excluded. Manufacturer warranties and any additional Orbit workmanship warranty are provided in addition to those rights.
Contact Orbit if you believe equipment or workmanship is faulty. We will assess the issue and provide any remedy required by law. You are not required to deal exclusively with a manufacturer.

These terms are governed by Queensland law and applicable Australian law.
